The Spectrum Stone Designs “Spectrum Stone Designs Natural Stone Charity Makeover Contest 2013” (“Contest”) begins at 12:00:00 PM Eastern Time (“ET”) on November 22, 2013 and ends at 12:00:00 PM Eastern Time (“ET”) on December 31. 2013.
1. ELIGIBILITY:
The Contest is open only to 501(c)(3) nonprofit organizations located in the Lynchburg, Virginia area. Charities must have a direct impact on and serve the Lynchburg, Virginia area. Charities that do not have a direct impact on or serve the Lynchburg, Virginia area are not eligible to participate in the “Contest.” Participating charities must have a physical facility in Lynchburg, Virginia. Charities without a physical facility in Lynchburg, Virginia are not eligible. Employees, agents, officers and directors of Spectrum Stone Designs, their respective parents, affiliates, subsidiaries, franchisees, divisions, advertising, promotional, fulfillment and marketing agencies, their immediate families (parent, child, sibling or spouse) and persons living in the same households as such individuals (whether related or not) are not eligible to participate in the Contest. By entering the Contest, participants agree to release, discharge and hold harmless Spectrum Stone Designs, their respective parents, affiliates, subsidiaries, franchisees, divisions, retailers, agencies and their respective officers, directors, employees and agents, from any and all damages whether direct or indirect, which may be due to or arise out of participation in the Contest or any portion thereof, or the acceptance, use/misuse or possession of prizes. By participating, you agree to these Official Rules and to the decisions of Spectrum Stones Designs, whose decisions are final and binding in all respects. All federal, state and local laws and regulations apply. Nominees cannot be individual.
2. HOW TO ENTER:
There are three (3) phases to the Contest: Phase 1: The Contest Submission Period; Phase 2: The Contest Voting Period; and Phase 3: The Grand Prize Winner Notification and Announcement.
Phase 1: Contest Submission Period: The Contest Submission Period begins at 12:00:00 PM Eastern Time (“ET”) on Friday, November 22, 2013 and ends at 5:00:00 PM Eastern Time (“ET”) on December 10, 2013. Nominations received after the Contest Submission Period are void and ineligible for consideration.
To nominate a charity, visit https://countertops.spectrumstonedesigns.com/natural-stone-makeover/. Enter the name of the charity you are nominating, the reason the charity deserves natural stone, a contact name at the charity, a contact phone number for the charity, a contact email for the charity, your first name, your last name and your email. By nominating a charity, you agree that your email address will be added to the Spectrum Stone Designs email list.
Spectrum Stone Designs will review all submissions and select up to six semi-finalist charities to participate in the voting period. Multiple nominations will not affect the charities selected. Charities selected to participate in the contest will be based on condition of cabinets and other foundations for natural stone and the charity’s impact on the Lynchburg, Virginia area.
By entering, participants acknowledge and agree that only the charitable organization will be eligible to receive the donation. No mechanically reproduced or completed entries will be accepted.
Nominations cannot be revised, altered or revoked once submitted. By entering, you grant Spectrum Stone Designs and anyone they may authorize permission to display your name on Spectrum Stone Designs’ website or social media outlets.
Privacy Policy: Spectrum Stone Designs will not sell, rent, transfer or otherwise disclose your personal data to any third party.
The Contest Entities shall have the right to disqualify any entries that they deem to be obscene, vulgar, sexually explicit, lewd, derogatory, inappropriate, or otherwise not in good taste, as determined by the Contest Entities in their sole discretion.
The Contest Entities are not responsible for late, lost, illegible, incomplete, stolen, garbled or misdirected entries, all of which are void.
Phase 2: Contest Voting Period:The Contest Voting Period begins on December 15, 2013 at 12 p.m. (noon). To vote, visit Spectrum Stone Designs’ Facebook page at www.facebook.com/spectrumstonedesigns. “Like” the Facebook page and vote for a charity to receive natural stone for their Lynchburg, Virginia facility. Only one vote per Facebook account. Verified Facebook accounts only eligible to vote. Voting must be done through Facebook. Voting ends December 31, 2013. The Grand Prize winning charity will be determined by the charity with the most votes as of December 31, 2013 at noon.
Spectrum Stone Designs decisions will be final and binding.
Phase 3: The Grand Prize Winner Notification and Announcement: The Grand Prize Winner will be notified between January 1, 2014 and January 15, 2014 and will be announced by January 31, 2014.
Contest Prizes: Sponsor will award one Grand Prize package to one charity winner. The Grand Prize is as follows: Natural stone fabrication and installation with a maximum value of $4,500. $4,500 worth of natural stone cannot be used for tile through Contest. No substitution of prizes, except at the discretion of Spectrum Stone Designs. Prizes may not be redeemed for cash value. If the charity selected declines to participate or is unable to fulfill Contest requirements or if, by reason of accident, illness or emergency, the charity is unable to participate or if the charity’s participation is terminated by Spectrum Stone Designs prior to natural stone fabrication and installation, there will be no cash compensation.
3. PRIZE AWARDING:
Limit: One Grand Prize per charity. The Contest Entities will award prizes only upon winner confirmation, verification and final approval. No substitution, transfer of any prize or cash alternative permitted, except by one of the Contest Entities who reserve the right, in its sole discretion, to substitute a prize of equal or greater value, if prize, or portion of prize, becomes unavailable. The winning charity may be notified by phone or e-mail and will be required to be available for installation on the dates selected by Spectrum Stone Designs in conjunction with charity leadership. The prize winner must agree that Spectrum Stones Designs, and anyone they may authorize, may without compensation publish, display and otherwise use winning charity’s name, photograph or other likeness, biographical information and statements, logo and / or mission statement for purposes of advertising and promotion without additional compensation. The potential winner then and only then becomes the “winner”.
Winning charity installation location must be in suitable condition (as determined by Spectrum Stone Designs or its designees) for installation of the prize (including compliance with local building codes and regulations). For example, no water, mold, structural damage, etc. All systems (electrical, plumbing, etc.) must be in functioning order and in compliance with local building codes. Any repairs or discovery items necessary for proper installation of the makeover elements must be performed at the charity’s expense prior to installation. The winning charity will receive written proposal and must agree and sign a contract to install the project as stated. Natural stone tile is not included in this contest.
The winner must also demonstrate to Spectrum Stone Designs, at least 30 days prior to fabrication and installation, a prior year W9 and proof of 501(c)(3) status. If the potential winning entrant of any prize cannot be contacted; is ineligible; fails to return the completed and executed Affidavit and Release, if the Prize Notification is returned undeliverable; or if the potential winner otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and the prize may be awarded to an alternate winner as selected by the Contest Entities.
Spectrum Stones Designs reserves the right to cancel or reschedule natural stone fabrication and installation, in whole or in part, in its sole discretion, as well as the right, in its sole discretion, to dismiss the winner from further participation as a result of conduct that is considered improper or offensive to the local community, is likely to be detrimental to the health or safety of the winner or other individuals, or demonstrates that the individual is not capable or unwilling to participate fully in the experience.
4. GENERAL CONDITIONS:
The Contest Entities are not responsible for technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, software or web site. The Contest Entities are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, for incorrect or inaccurate entry information, howsoever caused, or other error of any kind whether human, mechanical or electronic. Entrants found tampering with or abusing any aspect of this Contest, as solely determined by the judges, will be disqualified. If disqualified for any of the above abuses, the Entities reserve the right to terminate entrant’s eligibility to participate in the Contest. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be in violation of criminal and civil law, and, should such an attempt be made, the Contest Entities reserve the right to seek damages from any such person to the fullest extent permitted by law. The Contest Entities’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Contest Entities reserve the right to terminate, cancel, suspend and/or modify the Contest if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Contest, as determined by any of the Contest Entities in its sole discretion. In such event, the Contest Entities reserve the right to award the prize to the entrant whose submission has received the highest average and most number of votes at the time of the impairment. Only the stated number of prizes will be awarded. In no event will more prizes be awarded than those listed in Rule #3.
By entering the Contest and/or accepting the prize, entrants/prize winners agree to: (a) be bound by these rules; (b) release Spectrum Stone Designs, their parent companies, or organizations, subsidiaries, affiliates, advertising and promotion partners, fulfillment and/or judging agencies, agents and their estate and/or family members from all liability, claims, action, or proceedings relating to the Contest and from injuries or damages arising in connection with or relating to participation in the Contest, or use or misuse of the prize; and (c) waive any right to claim ambiguity in the Contest or these Official Rules. By accepting the prize, winner further acknowledges that the Sponsor and any other entity involved with this Contest have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied in fact or in law, relative to the prize or prize suppliers or to any portion thereof, including but not limited to its quality, merchantability, mechanical condition, or fitness for a particular purpose including, without limitation, use of any equipment associated with the prize. All taxes and other expenses not specified herein, including federal, state, local, and departure, licenses and registrations, are the sole responsibility of the winner. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest, to void suspect entries and/or cancel, terminate or suspend any portion of this Contest should a virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Contest and, in any such event, at its discretion, select winners from eligible, non-suspect entries received prior to the event requiring such termination, cancellation or suspension.
5. TAX INFORMATION:
All federal, state, local and other taxes on prizes are the sole responsibility of the applicable winner.
6. DISPUTES:
Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and the Contest Entities in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Pennsylvania, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Virginia.
